1. General Provisions

The General Terms and Conditions of the online store are drawn up in accordance with the Consumer Protection Act (ZVPot-1), the Electronic Commerce on the Market Act (ZEPT), the Personal Data Protection Act (ZVOP-2), and the EU General Data Protection Regulation (GDPR).

The General Terms and Conditions govern the operation of the online store, the rights and obligations of the customer, and the business relationship between the provider and the customer. By submitting an order, the customer confirms that they are familiar with the entire text of the general terms and conditions and agree with them completely.

2. Accessibility of Information

The provider undertakes to provide the customer with the following information before they are bound by a contract or offer:

  1. Company information (name, registered office, registration and VAT numbers).

  2. Contact details for fast and effective communication.

  3. Essential characteristics of the goods or services.

  4. Availability of products (every product offered on the website should be accessible within a reasonable time).

  5. Conditions, deadlines, and procedures for the delivery of goods.

  6. Clearly specified prices (all prices include VAT).

  7. Method of payment and delivery.

  8. Information regarding the right to withdraw from the contract and the conditions for withdrawal.

3. Prices, Product Offer, and Symbolic Photographs

All prices in the online store are stated in Euros (€) and already include Value Added Tax (VAT). Prices are valid at the time of submitting the order and do not have a predetermined period of validity. Delivery costs are not included in the product prices and are charged additionally before the completion of the order.

The online store reserves the right to change prices and offers without prior notice. Despite exceptional efforts to ensure up-to-date data, it may happen that a price or stock availability information is incorrect. In such case, the provider will allow the customer to withdraw from the purchase or offer another solution.

Textual and Visual Product Information: All product photographs on the website are symbolic and do not guarantee the actual properties or exact appearance of the product (minimal deviations may occur in packaging, shape, or color shades of natural ingredients). The provider reserves the right to unintentional typographical and textual errors in product descriptions, instructions for use, and price indications.

4. Purchase Process (Conclusion of Contract)

The sales contract between the provider and the customer is concluded at the moment the provider sends the customer the first e-mail confirming their order (Subject: Order Confirmed / Received). From this moment on, all prices and other conditions are fixed and apply to both the provider and the customer.

The sales contract (order) is stored in electronic form on the provider's server and is accessible to the customer at any time via their user account (if registered) or upon request via e-mail.

5. Methods of Payment

The provider enables the following payment methods:

  • Cash on Delivery: The customer pays in cash or by card to the delivery service provider upon receiving the package (in Slovenia only).

  • Proforma Invoice (Bank Transfer): The customer receives the payment details via e-mail. After receipt of the payment to the company's bank account (Hranilnica Lon, IBAN: SI56 6000 0000 0971 623, SWIFT: HLONSI2), the order is dispatched.

  • Credit Cards / External Payment Providers: (Bankart).

6. Delivery and Takeover of Goods

The provider will deliver the ordered products within the agreed timeframe. The partner service for package delivery is Pošta Slovenije.

If a product is out of stock or delivery will take longer, the customer will be notified via e-mail or telephone as soon as possible. The provider is not liable for any delays caused by the delivery service.

7. Right to Withdraw from the Contract (Return of Goods)

In accordance with ZVPot-1, the customer (who is considered a consumer) has the right to notify the company within 14 days of receiving the goods that they are withdrawing from the contract, without needing to state a reason for their decision.

  • Withdrawal Notice: The customer informs the provider of the withdrawal via e-mail at info@dr-gosar.si.

  • Deadline for Returning Goods: The customer must return the goods to the company no later than 14 days after sending the notice of withdrawal from the contract to the address: DR. GOSAR d.o.o., Selo pri Vodicah 23, 1217 Vodice, Slovenia.

  • Return Costs: The only cost borne by the customer in connection with the withdrawal from the contract is the direct cost of returning the goods (postage).

  • Condition of Goods: Products must be returned undamaged, in their original packaging, and in an unaltered quantity. The customer may not freely use the products until withdrawal from the contract, but may only perform a basic inspection of the properties to the extent strictly necessary (just as they would do in a physical store).

  • Exceptions to Withdrawal: The consumer does not have the right to withdraw from the contract in the case of sealed goods that are not suitable for return due to health protection or hygiene reasons, if the consumer opened the seal after delivery (e.g., opened cosmetic products, food supplements, or natural extracts).

  • Refund of Purchase Price: The provider returns all received payments no later than 14 days after receiving the notice of withdrawal from the contract. The company may withhold the refund of received payments until it has received the returned goods back or until the customer provides proof that they have sent the goods back.

8. Non-Conformity of Goods (Material Defect)

The provider is liable for non-conformities of goods that appear within two years of delivery of the goods, in accordance with the provisions of ZVPot-1. The customer must notify the provider of the non-conformity at info@dr-gosar.si, describe the defect in detail, and enable the provider to inspect the product.

9. Protection of Personal Data (GDPR)

The provider undertakes to permanently protect all personal data of the user in accordance with GDPR and ZVOP-2. The data will be used exclusively for the successful execution of the order (payment processing, invoicing, package delivery) and for sending e-newsletters and promo codes, provided that the customer gave explicit consent during registration or purchase ("I want to subscribe to the newsletter").

The user has the right at any time to request access to, correction of, restriction of processing, or deletion of their personal data by writing to the e-mail address info@dr-gosar.si.

In accordance with the applicable Electronic Communications Act (ZEKom-2), the provider may use the e-mail addresses of persons who have made a purchase (customers) to send notifications about benefits, promo codes, and e-newsletters for similar own products or services, unless the customer has prohibited such use in advance or subsequently opted out. The customer can unsubscribe from receiving such notifications at any time, free of charge and easily, via the unsubscribe link provided in every e-mail.

10. Limitation of Liability and Nature of Products

The products and information presented in the DR. GOSAR d.o.o. online store are not intended to diagnose, treat, or prevent any disease. Product descriptions and their properties are based on scientific findings in biotechnology and the natural properties of the ingredients, but they do not replace professional medical advice, diagnosis, or prescribed medications. Consult a doctor or pharmacist before use.

11. Copyright and Intellectual Property

All content published on the online store's website (texts, graphic elements, logos, photographs, trademarks, video materials, and program code) is the property of DR. GOSAR d.o.o. or the company has permission to use it. Any copying, reproduction, transcription, or distribution of content for commercial purposes without prior written permission from the company is strictly prohibited and punishable by law.

12. Complaints and Disputes

The provider complies with applicable consumer protection legislation and ensures an efficient complaint handling system. A complaint is submitted via the e-mail address info@dr-gosar.si. The provider will confirm receipt of the complaint within five working days and keep the customer informed about the progress of the procedure.

Out-of-Court Settlement of Consumer Disputes

In accordance with legal norms, DR. GOSAR d.o.o. does not recognize any provider of out-of-court settlement of consumer disputes as competent to resolve a consumer dispute that a consumer may initiate in accordance with the Out-of-Court Settlement of Consumer Disputes Act.

13. Final Provisions (Severability Clause)

If any provision of these general terms and conditions is found to be inconsistent with legislation, invalid, or unenforceable, this does not affect the validity, legality, and enforceability of the remaining provisions of these general terms and conditions, which shall remain in full force and effect.
